Terms of Service for Kinderwell

1. Agreement to Terms
By accessing or using the Kinderwell mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Kinderwell ("we," "us," or "our").
2. Description of Service
Kinderwell is a parenting education application that provides:
- Evidence-based parenting lessons and content
- Interactive quizzes and assessments
- Progress tracking across devices
- Subscription-based access to premium content
3. Eligibility
To use Kinderwell, you must:
- Be at least 18 years old
- Be legally capable of entering into binding contracts
- Provide accurate registration information
- Maintain the security of your account
4. Account Registration
4.1 Creating an Account
- You must create an account using Google Sign-In or Apple Sign-In
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information
- You may not create multiple accounts or share your account with others
4.2 Account Security
- You are responsible for all activities that occur under your account
- Notify us immediately of any unauthorized use at kinderwellteam@gmail.com
- We are not liable for any loss or damage from unauthorized account access
4.3 Account Termination
You may delete your account at any time through the Settings screen. Upon deletion:
- All your personal data will be permanently deleted within 30 days
- Your subscription will be cancelled (subject to Apple's refund policy)
- This action cannot be undone
5. Subscription and Payment Terms
5.1 Subscription Plans
Kinderwell offers the following subscription options:
- Monthly Plan: $12.99/month, automatically renews monthly
- Annual Plan: $69.99/year, automatically renews yearly
Prices are subject to change with notice.
5.2 Payment Processing
- All payments are processed through Apple In-App Purchase
- You must have a valid payment method on file with Apple
- By subscribing, you authorize Apple to charge your payment method
5.3 Automatic Renewal
- Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period
- Your Apple account will be charged within 24 hours prior to the end of the current period
- You can manage or cancel your subscription in your Apple Account Settings
5.4 Free Trials
- We may offer free trials for new subscribers
- If not cancelled before the trial ends, you will be charged the subscription fee
- Free trial eligibility is determined by Apple
5.5 Refunds
- All purchases are subject to Apple's refund policy
- To request a refund, contact Apple Support or go to your Apple purchase history
- We do not have access to process refunds directly
- Refunds are at Apple's sole discretion
5.6 Cancellation
To cancel your subscription:
- Go to Settings → Manage Subscription in the app, OR
- Open iPhone Settings → Your Name → Subscriptions → Kinderwell → Cancel
Cancellation takes effect at the end of the current billing period. You will retain access until then.
6. Acceptable Use
6.1 You Agree NOT To:
- Use the App for any illegal purpose
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload viruses or malicious code
- Attempt to hack or compromise the App's security
- Reverse engineer or decompile the App
- Share your account credentials with others
- Use the App in any way that could harm minors
- Scrape or collect data from the App
- Impersonate any person or entity
6.2 Content Usage
- All content in the App is for personal, non-commercial use only
- You may not reproduce, distribute, or create derivative works from our content
- You may not screenshot or record lessons for distribution
7. Intellectual Property Rights
7.1 Our Content
All content in the App, including but not limited to:
- Text, graphics, images, videos
- Lesson materials and quizzes
- Software code and functionality
- Trademarks and logos
is owned by Kinderwell or our licensors and is protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the App for personal use
- View and interact with the content as intended
This license terminates when your subscription ends or your account is deleted.
8. Disclaimer of Warranties
8.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of content
8.2 No Professional Advice
Kinderwell provides educational content only. It is NOT:
- Medical advice
- Mental health counseling
- Professional therapy or treatment
- A substitute for professional care
If you or your child needs professional help, consult a qualified healthcare provider or licensed therapist.
8.3 No Guarantees
We do not guarantee:
- Uninterrupted or error-free service
- Specific parenting outcomes or results
- That the App will meet all your needs
- That all content is accurate or up-to-date
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
9.1 No Liability for Damages
WE SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or goodwill
- Personal injury or property damage
- Damages resulting from your use or inability to use the App
9.2 Maximum Liability
Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is less.
9.3 Parenting Decisions
You are solely responsible for all parenting decisions and actions. We are not liable for any outcomes or consequences of implementing strategies or advice from the App.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last Updated" date
- Posting a notice in the App
- Sending you an email
Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.
11. Termination
11.1 Your Right to Terminate
You may terminate your account at any time by deleting it through the Settings screen.
11.2 Our Right to Terminate
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the service or other users
- Fail to pay subscription fees
11.3 Effect of Termination
Upon termination:
- Your access to the App will cease immediately
- Your data will be deleted in accordance with our Privacy Policy
- Paid subscriptions are non-refundable unless required by law
12. Dispute Resolution
12.1 Informal Resolution
Before filing a legal claim, you agree to contact us at kinderwellteam@gmail.com to attempt informal resolution.
12.2 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
13. Apple-Specific Terms
13.1 Acknowledgment
You acknowledge that:
- These Terms are between you and Kinderwell, not Apple
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support or maintenance
13.2 App Store Terms
Your use of the App must comply with the Apple App Store Terms of Service.
